Article 1a. Definitions

  1. In these terms and conditions of Tye-O-Matic / tomnet.nl, the following definitions apply:
  2. Web retailer: the online retailer as referred to under Article 1b.
  3. Consumer: any person who uses or wants to use the products and/or services of the webshop.
  4. Written: communication via letter (card), fax, email or via the website.
  5. Reflection period: the period in which the consumer can return/cancel the order without giving any reason.
  6. Days: All day designations in these terms and conditions are calendar days.
  7. Remote: All agreements concluded without the physical presence of a seller/employee,
    in particular via a webshop, but also via telephone, fax, email and in writing.

Article 2. Applicability

  1. These general terms and conditions apply to all agreements between the web retailer and the consumer.
  2. These general terms and conditions are transparent in advance of the agreement, which is concluded at a distance by the consumer and online retailer.
  3. These general terms and conditions can be obtained in writing free of charge upon request and digitally via the internet or email.

Article 3. Limited-time offers and promotion periods

  1. After the closing date of a temporary offer or promotion period, the consumer can no longer use the relevant offer or promotion.
  2. The online retailer determines whether offers or promotions are accessible to the consumer.
  3. For temporary offers and/or during promotional periods, different or additional conditions may apply to these general terms and conditions.

Article 4. Delivery

  1. Delivery of individual orders takes place by personal delivery or by sending to the address specified by the consumer.
  2. The online retailer will send the product within 15 days. If this term is exceeded, the consumer has the right to still demand fulfillment or to dissolve the agreement. Some products have a longer delivery time. This is stated with the product or will be reported to the consumer as soon as possible after ordering.
  3. After dissolution as referred to in part 2 of this article, the online retailer will refund any amount already paid within fourteen days.

Article 5. Reflection period

  1. During fourteen days following the day of receipt of the individual order, the consumer can dissolve the agreement (in writing) without stating reasons. However, this cooling-off period does not apply to custom-made products. After dissolution, the consumer has another period of 14 days for the actual return.
  2. During the cooling-off period, the consumer will handle the product and packaging with care, and will only unpack or use it to the extent necessary to assess whether he wants to keep the product. If the consumer makes use of his right of withdrawal, he will return the product with all accessories supplied and - if reasonably possible - in its original condition and packaging to the return address as stated in Article 11.
  3. After dissolution as referred to in paragraph 1, the online retailer will refund any amount already paid within fourteen days after receipt of the return.

Article 6. Conformity

  1. Webshop guarantees that the delivered product has the properties that, taking all circumstances into account, are necessary for normal use.

Article 7. Late payment

  1. The consumer is in default from the expiry of the payment date of the payment method chosen when purchasing the product in question.
  2. If the consumer has not paid after two payment reminders, the online retailer can charge collection costs and/or hand over the claim to a collection agency.
  3. The web retailer can charge interest on payments that have not been made on time, from the expiry of the payment date until the day of receipt of the amount due. This interest is equal to the statutory interest.

Article 8. Non-performance

  1. If the online retailer or consumer does not (partially) fulfill one or more obligations under the agreement, the other party is entitled to suspend the fulfillment of the corresponding obligation, insofar and insofar as the shortcoming justifies this.< /li>
  2. If the online retailer or consumer fails to (partially) fulfill one or more obligations under the agreement after a reminder, the other party may dissolve the agreement, unless the shortcoming does not justify this in view of its special nature or minor significance.

Article 9. Liability

  1. Webshop makes every possible effort to guarantee the topicality and correctness of the information and advice provided. However, using the information and/or following the advice of the online retailer by the consumer is at your own risk.
  2. Webshop is not responsible for defects that have arisen after delivery, as a result of incompetent use or lack of care on the part of the consumer, or which are the result of changes that the consumer or third parties have made to the delivered goods. Nor is the online retailer liable for damage as a result of such defects.

Article 10. Change of personal data

  1. Changes of personal data can be communicated in writing to the Service & Advice from online retailer/webshop.

Article 11. Returns and cancellation during the reflection period

  1. If the consumer makes use of the right of withdrawal within the cooling-off period, he/she must do so in writing within the cooling-off period of fourteen days via the withdrawal form which is made available on the Tye-O-Matic / tomnet.nl webshop and which has been reported or included. is sent by physical or electronic means in the ordering process. Otherwise, the consumer has the right to report this in an unambiguous manner other than via the withdrawal form.
  2. In the case of physical products, the consumer returns the order complete and in its original condition and original, undamaged packaging.
  3. Costs for returning are at all times borne by the consumer, unless otherwise agreed in writing between the web retailer and the consumer. The consumer is responsible for the return. It is also possible to have the delivered goods returned. The costs of this are &euros; 30,- ex. VAT.
  4. When an agreement is revoked, all additional rights/obligations of both the online retailer and consumer will lapse. The address below applies to returns to the online retailer.

  5. In the event of an incorrect delivery of the ordered product(s), the costs for returning or exchanging will of course be borne by the Pavement Boards Shop.

Article 12. Complaints

  1. Complaints can be made via the contact options as stated in Article 1b. Your complaint will be processed as soon as possible.
  2. If the consumer disagrees with the handling of the complaint, the consumer can submit the complaint to the online retailer within a reasonable period of time after handling, in writing and with reasons.
  3. The online retailer informs the consumer in writing within thirty days to what extent the complaint has been found to be well-founded and to what extent his objections have been met.

Article 13. Privacy

  1. The way in which the online retailer handles personal data provided by consumers is laid down in a privacy statement.
  2. The privacy statement can be viewed via the website tomnet.nl.

Article 14. Copyright

  1. It is not permitted to reproduce or make available to third parties the content of the website, or any other copyrighted information provided or made public by the online retailer, without permission.

Article 15. Applicable law

  1. Unless expressly agreed otherwise, all agreements to which these general terms and conditions apply are governed by Dutch law.

Article 16. Changes

  1. Webshop owner reserves the right to make changes to these terms and conditions.
  2. Individual deviations from these general terms and conditions must be recorded in writing between the web retailer and the consumer.

Article 17. Your consumer data

  1. We would like to point out that it is not permitted as a consumer to knowingly provide incorrect information.

Article 18. Disputes

  1. On agreements between web retailer and consumer to which these general terms and conditions apply, only Dutch law applies.
  2. Disputes between the consumer and the entrepreneur about the conclusion or implementation of agreements with regard to products to be delivered or delivered by this online retailer can only be submitted to a disputes committee after extensive consultation between the consumer and the online retailer to which both parties agree. .
